November 19th, 2024 Lady Liberty Hong Kong unequivocally condemns the recent sentencing of 45 pro-democracy activists in Hong Kong, including esteemed legal scholar Benny Tai and professional journalist Gwyneth Ho. The severe prison terms, ranging from four years and two months to ten years, represent a profound violation of the fundamental right to freedom of expression. Our organization was founded on the belief that freedom of expression is a natural and inalienable right inherent to all individuals. The convicted activists were exercising this right by participating in an unofficial primary election in July 2020, aiming to voice their political opinions and engage in the democratic process. Criminalizing peaceful political participation and free speech under the pretext of national security is a gross misuse of power that undermines the very foundations of a just and open society. We highlight that this sentencing contravenes the International Covenant on Civil and Political Rights (ICCPR), to which Hong Kong is a signatory. Specifically, Article 19 of the ICCPR guarantees the right to freedom of expression, including the freedom to seek, receive, and impart information and ideas of all kinds, regardless of frontiers. The actions taken against these activists directly violate these internationally recognized human rights obligations. The use of the Beijing-imposed National Security Law to suppress dissent distorts legitimate expressions of opinion into alleged threats against national security. This not only erodes the rule of law but also sets a dangerous precedent where basic freedoms are curtailed in the name of security. Such actions betray the promises made under the “One Country, Two Systems” framework and diminish Hong Kong’s standing as a global city committed to upholding human rights. Lady Liberty Hong Kong board member, Tokyo University Professor Tomoko Ako says: “45 defendants of The ‘Hong Kong 47’ Case were found guilty of violating the National Security Law for conspiring to subvert state power. The governments of China and Hong Kong claim that the National Security Law is essential for maintaining social stability, but what has actually happened as a result of strengthening surveillance and control in the name of ‘national security’? The government should take a good look at reality. People are plagued by anxiety, the economy is losing vitality, the gap between rich and poor is widening, and public safety is deteriorating. People create new value by connecting with each other, communicating, and embracing diverse ideas. We have once again recognized that those who were sentenced this time were striving to create new value for the future of Hong Kong.” We stand in solidarity with all those unjustly imprisoned for merely expressing their views and participating in peaceful political activities. The sentencing sends a chilling message that freedom of expression is no longer protected in Hong Kong, and that speaking one’s mind can lead to severe punishment. We call upon the Hong Kong government to: Immediately release all political prisoners and cease using the National Security Law to criminalize free speech and peaceful political expression. Respect and uphold the fundamental right to freedom of expression, as guaranteed by the International Covenant on Civil and Political Rights. Engage in open and constructive dialogue with all sectors of society to address concerns and restore confidence in the protection of basic freedoms. Furthermore, we urge the Japanese government to: Work with regional partners to condemn these unjust sentences and the violation of the “One Country, Two Systems” principle by the Hong Kong authorities. Support the people of Hong Kong by providing asylum to those who are oppressed for exercising their right to free expression. The freedom of expression is not a threat to national security; it is the cornerstone of a vibrant and progressive society. Silencing dissenting voices through legal persecution harms not only the individuals involved but also the social fabric of Hong Kong and its reputation on the global stage. Lady Liberty Hong Kong remains steadfast in our commitment to advocating for the protection of freedom of expression. We will continue to support the rights of all Hongkongers to speak freely without fear of retribution. Freedom of expression is a natural right, not a crime.
